How do I sue for not getting paid

I know this is a dirty business and I see alot of you have problems sometimes getting paid and that has never happend to me until now and I'm not going to let it slide. I've just finished a project and only got paid two thirds of the agreed price. Payer says he messed up and gave me the wrong pricelist. This was told to me when the check was handed to me. I have a contract with him signed agreeing to pay me the original price that we discussed. Work is to specs and now I have to pay my guys and stay with zero for me. Is this a winable case?? Is a lawyer going to cost too much?? Should I file a sivel suite and will that work?? Should I get my shovel and smash it into his face??

Any help will be appreciated
