Retainage, Lawyers, & 1099's

I have seen people posting about going to court to try to get their retainers paid, I'd like some advice from someone who has or is going through the same. I do know that would probably include 99% of the bar (angry) but I am wondering about the legal aspect of it all. My questions are...
Are you able to find attorneys with contingent fees?
What exactly is the law as far as being 1099'd on money you have not yet received? I would appreciate any help or advice any of you have to offer so that I have some idea of what I am getting into before I begin.
