Exactly . There is no such creature as a 1099 employee . The cable industry is one of the worst for misclassifying people as 1099 workers . Companies rely on the fact many people just dont know the labor laws and what they are entitled too . A few years back the IRS cracked down on cable TV installer industry and nailed number of large contractors .One was hit with over a million dollars they had to pay . The IRS will come after you hard for payroll taxes and employees can sue for back OT wages . All the 1099 Ads went away and everyone changed to employee based for a few years and many went bankrupt because its almost near impossible to pay people, as employees when the rates are so low from the primes or even direct from companies like Comcast . I had a contract with WOW cable and they had great rates and I paid everyone as employees from the start . I did get hit early on with OT ruling as I had no idea at the time if you pay piece rate you still had to have an overtime factor .Luckily it was caught early on and I adjusted my rates to cover OT and the techs still made what they expected as I just lowered my rates but paid everyone 20 hours of OT each week whether they worked it or not and that raised the piece rate back up too what the techs were expecting .
