California prime here.

Well the CA law is pretty clear, you cannot have  1099 employees in California. However piece rate is a different subject. You can work on production in California, it just can’t be less than the minimum wage so if you have a bad day production wise you should at the bare minimum make a minimum wage for that day. You can be on piece rate as a W2 employee, we have several guys that rather work on piece rate.
