You right.  Civil and Criminal are separate and don't cancel each other out.  If the settlement referenced for the overtime was part of a civil suit, Res Judicata (This matter has already been decided) might apply for any other civil action arising from the same set of circumstances.  Was a release signed as part of the overtime pay settlement?
