You are "legally" an Employee! UNLESS you signed a Employee /1099 subcontract agreement. Which could be legal in the State where it was signed and it might not be.
Some States do not care what kind of contract agreement is signed. NOTHING overrides the laws of the State or Ferderal in most cases.(deal)
States laws to vary.
It is most definately accurate that the PRIME Contractors and even SUBCONTRACTORS have gotten away with MURDER in this paticular situation.
You need to consult your the "States IRS and or Labor Laws Office" wherever it is you are performing the work!
