The cable TV industry is ripe with misclassification of employees as IC . Knight Communicatikns and some others were nailed  by the IRS . To be an actual IC there are a number of IRS tests that a person has to pass. Just look up IRS and IC and you will find the questions that have to be answered . If you are misclassified you can go nad sue the employer for back wages  and OT
