  I'm not sure why people pretend to be helping, they can not answer your question without seeing your Contract... Look in the Insurance clause section, doesit say they can charge you if you are not overed, it usually will have a coverage clause, and the retainage is and can be used for Any money damages of losses incurred by the Company...
 Your contract is just that,, it is your Bible.. read it.
