OSHA fined DKS Sturctual Services Inc of Huntsville for 3 safety violations, along with the fact that the company terminated an employee who refused to enter a 6-15ft trench W/O cave in protection. Employee to receive back pay, interest with compensatory and punitive damage. Contractor's Fines total $122,400
Every employee has the right to refuse to enter an unsafe work area. Area could be aerial, underground, residential, commercial, industrial. Any work area that contractor is being paid to provide contractual services.
