The fact is, this is the exact reason America is the greatest: if there's a debate over the legality of an act, it will occur in a court of law with witnesses and the ability to defend oneself to their utmost and without limit. In this case, the ACLU is backing the rider against the wiretapping charges, but not for the reckless endangerment of his driving. The Maryland Attorney General has just issued a ruling that states that, unless the recording is made in a serreptitious manner, the acts of public figures performing their duties in public places have no reasonable expectation of privacy and may be recorded, so the charges will likely be dropped October 12th when he goes to court.

The guy needs his driving privileges permanently revoked for his acts of public endangerment, but he won't see any time in jail beyond his initial 26 hours when arrested for his act of filming.
