They would have to have a papertrail that showed the subs invoices were made up also. My guess is that he made up the invoices to buy time so that subs could get paid ontime while he waited on his money. The problem he probably ran into is that the job shut down before he could get paid enough to "correct" those bogus invoices.
Again...just a guess. I'm really don't mean to bash. Sometimes desperate people do the wrong thing and they can never catch up.
